Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Tableify, a software service operated by ION Hospitality (“Tableify”, “we”, “us”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Account registration
You must provide accurate information when creating an account, keep your credentials confidential, and notify us promptly of unauthorized use. You are responsible for all activity under your account. You must be at least 18 years old and authorized to bind the business you represent.
2. The service
Tableify provides a software platform that helps restaurants manage private event inquiries, multi-channel customer conversations, sales pipelines, payments, and digital content. The Service integrates with third-party providers (such as your POS, Stripe, Meta, and similar services) at your direction. We do not control those third parties and are not responsible for their availability, accuracy, or actions.
3. Subscription and billing
Paid plans are billed in advance on a recurring basis through Stripe. By subscribing, you authorize us to charge your payment method for the applicable fees plus any taxes. Subscriptions auto-renew until canceled. Fees are non-refundable except as required by law or expressly stated in our policies. We may change pricing on prospective renewal terms with notice.
4. Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. Your data remains accessible during this period; after, it is retained per our Privacy Policy and may be permanently deleted on request.
5. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, deceptive, or abusive purposes
- Send spam, unsolicited messages, or content that violates anti-spam laws (CAN-SPAM, TCPA, CASL, GDPR ePrivacy)
- Attempt to reverse-engineer, scrape, or interfere with the Service
- Upload malicious code, infringe IP rights, or impersonate others
- Resell, sublicense, or white-label the Service without our written consent
You are solely responsible for the content you upload, the messages you send through the Service, and your compliance with applicable laws (including marketing consent, contact preferences, and data-subject rights).
6. Your content and data
You retain ownership of all content and data you upload (“Customer Data”). You grant Tableify a limited license to host, process, and display Customer Data solely as needed to operate the Service. We do not use your Customer Data to train AI models for any purpose outside your own brand.
7. Third-party integrations
When you connect a third-party service (e.g., your POS, Stripe, Meta), your use of that service is subject to its own terms and privacy policy. You authorize Tableify to access and exchange data with those services on your behalf to provide the Service.
8. Templates, agreements and documents you send
The Service includes starting templates, such as a standard event agreement, and tools to send agreements, invoices, payment links and other documents to your guests and customers. Templates are provided for convenience only and are not legal, tax or financial advice. You are solely responsible for reviewing, editing and approving every template and document before you use it, for deciding whether it fits your business and complies with the laws that apply to you, and for every agreement you enter into with your guests and customers. We encourage you to have your own attorney review any agreement before you use it.
Agreements and documents you send through the Service are between you and the recipient. Tableify is not a party to them, does not review them, and makes no promise that any template is complete, suitable or enforceable. To the maximum extent permitted by law, Tableify is not responsible for the content of those documents or for how they are used, and Sections 10, 11 and 12 apply to them. Before the Service sends an agreement built from a Tableify template, you will be asked to confirm that you have reviewed and approved it, and we keep a record of that confirmation.
9. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by Tableify and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription term.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or fully secure.
11. Limitation of liability
To the maximum extent permitted by law, Tableify and ION Hospitality shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our aggregate liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Tableify and ION Hospitality from any claims arising out of your use of the Service, your Customer Data, or your violation of these Terms.
13. Termination
We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that creates legal or operational risk for us or other users. On termination, your license to use the Service ends and your data may be deleted per our Privacy Policy.
14. Communications and consent
By giving Tableify your phone number (for example, when you create an account, request a plan, or use one of our free tools), you agree to receive marketing texts, marketing emails, and marketing phone calls from Tableify. Any marketing phone calls are placed manually by a person; we do not use autodialers, prerecorded messages, or artificial-voice messages for marketing calls. Message and data rates may apply to texts, and message frequency varies. You can reply STOP at any time to opt out of texts, or use the unsubscribe link in any email to opt out of marketing emails. Consent to receive marketing communications is not a condition of any purchase. We may still send you service-related messages needed to operate the Service. You remain responsible for obtaining any consent required to contact your own guests and leads through the Service (see Section 5).
15. AI assistants and monitoring
The Service includes AI assistants and agents you can chat with. We may store, monitor, and review your interactions and conversations with these assistants for quality assurance, support, safety and security, and to improve the Service, as further described in our Privacy Policy.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via email or in-app notice. Continued use after changes take effect constitutes acceptance of the updated Terms.
17. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in New York County, New York.
